GFunnel Business LLC ("GFunnel," "we," "us," or "our") operates as a service provider under the Digital Millennium Copyright Act ("DMCA," 17 U.S.C. § 512) and is committed to respecting the intellectual property rights of others. This DMCA Policy governs the handling of copyright infringement claims related to content hosted, transmitted, or managed through our services, software, and platforms (collectively, "Services"), including but not limited to the GFunnel Platform, Branded Flows AI software, GFunnel Email, SMS GFunnel, CRM, and Websites, used by Clients and their employees, staff, partners, or authorized representatives (collectively, "Users"). Clients include individuals or entities, including Independent Business Contractors (IBCs) acting as clients, affiliates, or members, using the Services to manage business operations or serve third parties. This policy outlines procedures for submitting DMCA takedown requests and counter-notices, ensuring compliance with the DMCA and protecting GFunnel from liability.

1. Purpose

This DMCA Policy establishes the process for addressing claims of copyright infringement on GFunnel’s Services, in accordance with the DMCA. It complements the Terms of Service (https://www.gfunnel.com/terms), Privacy Policy (https://www.gfunnel.com/privacy), Acceptable Use Policy (https://www.gfunnel.com/acceptable-use-policy), AI Acceptable Use Policy (https://www.gfunnel.com/ai-acceptable-use-policy), and Code of Conduct (https://www.gfunnel.com/code-of-conduct). GFunnel does not endorse or control user-generated content but provides mechanisms to address infringement claims promptly.

2. Submitting a DMCA Takedown Request

If you believe that content hosted or transmitted through GFunnel’s Services infringes your copyright, you or your authorized agent may submit a DMCA takedown request to our Designated Copyright Agent. To be effective, the request must include the following information, as required by 17 U.S.C. § 512(c)(3):

  • A physical or electronic signature of the copyright owner or their authorized agent.
  • A description of the copyrighted work claimed to be infringed, including details sufficient to identify it (e.g., title, URL, or other identifying features).
  • A description of the infringing material and its location on GFunnel’s Services (e.g., specific URL or platform section), with enough detail to allow us to locate it.
  • Your contact information, including name, address, telephone number, and email address.
  • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

Upon receipt of a compliant takedown request, GFunnel will promptly notify the responsible User and remove or disable access to the allegedly infringing content, as required by 17 U.S.C. § 512(c).

3. Submitting a DMCA Counter-Notice

If you believe your content was removed or disabled in error due to a DMCA takedown request, you may submit a counter-notice to our Designated Copyright Agent. To be effective, the counter-notice must include, per 17 U.S.C. § 512(g)(3):

  • Your physical or electronic signature.
  • Identification of the content that was removed or disabled, including its location (e.g., URL) before removal.
  • A statement under penalty of perjury that you have a good faith belief the content was removed or disabled due to a mistake or misidentification.
  • Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or the District of Wyoming if outside the U.S.) and will accept service of process from the party who submitted the takedown request.

Upon receipt of a compliant counter-notice, GFunnel will provide a copy to the original complainant. Unless the complainant files an action seeking a court order within 10 business days, GFunnel may restore the content or access, at our discretion, per 17 U.S.C. § 512(g).

4. Client Responsibilities

As a Client, you are responsible for ensuring that your employees, staff, partners, and other authorized Users comply with this DMCA Policy and applicable copyright laws. Your responsibilities include:

  • Content Compliance: Ensuring all content uploaded, hosted, or transmitted via the Services (e.g., websites, emails, AI-generated outputs) does not infringe third-party copyrights.
  • Training and Monitoring: Training Users on copyright compliance and monitoring their use of the Services to prevent infringement, especially when serving third parties.
  • Responding to Notices: Promptly responding to GFunnel’s notifications of takedown requests and providing accurate information for counter-notices, if applicable.
  • Liability: You are liable for any copyright infringement by your Users, including damages, losses, or expenses incurred by GFunnel, as specified in the Terms of Service (Section 16).

5. Enforcement

GFunnel will promptly investigate and respond to valid DMCA takedown requests and counter-notices. If GFunnel determines, in its sole discretion, that you or your Users have engaged in copyright infringement, GFunnel may:

  • Remove or disable access to the infringing content without notice.
  • Suspend or terminate access to the Services for you or specific Users, particularly for repeat infringers, as determined by GFunnel.
  • Pursue remedies under the Terms of Service, including termination of the Agreement or collection of damages.

GFunnel has no obligation to prescreen or monitor content but may do so to enforce this DMCA Policy. You agree to cooperate with GFunnel in resolving infringement claims.

6. Repeat Infringer Policy

In accordance with the DMCA, GFunnel may terminate the accounts of Users who are repeat infringers, as determined in our sole discretion. This applies to Clients and their employees, staff, or partners who repeatedly upload or transmit infringing content.

7. Client Indemnification

You agree to indemnify and hold GFunnel harmless from any claims, damages, losses, or expenses, including reasonable attorneys’ fees, arising from copyright infringement by you or your Users, including content generated via the Branded Flows AI software, as specified in the Terms of Service (Section 16).

8. Updates to this DMCA Policy

GFunnel may update this DMCA Policy to reflect changes in the Services, legal requirements, or business needs. Updates will be posted at https://www.gfunnel.com/dmca-policy, with the "Last Updated" date revised. You will be notified of material changes via email or GFunnel platform notification. Continued use of the Services after updates constitutes acceptance of the revised DMCA Policy. If you do not agree with changes, you must notify GFunnel in writing within 30 days at onestop@gfunnel.com, and the prior policy will apply until the end of your current Term.
